Abstract

This research addresses the lack of justificatory force in contemporary manifestations of the right to life within the international human rights system. Using an analytical-comparative methodology, the study clarifies the capacity of modern human rights frameworks while presenting the Quranic teachings as a viable approach to addressing the justificatory challenges of the right to life in the context of genocide. The paper argues that the Quran’s perspective on the primacy of the individual (Asālat al-Fard) and the primacy of society (Asālat al-Mujtama’) provides a comprehensive and appropriate foundation for the right to life, particularly in cases of genocidal crimes.
